Many private pipelines in the public right-of-way, including streets, alleys, and some creeks, are permitted to carry fluids through a pipeline license. On many occassions a pipeline license is appropriate for smaller utility owners that do not wish to enter into a franchise agreement to compensate the City for use of the public right-of-way. A pipeline license can be issued by the office of the City Engineer. Licensed utilities are charged an annual fee per foot of utility in the right-of-way. The fee is established by the public works director and is currently $1 per foot.
Some entities, such as Certificated Telecommunications Providers (CTPs), listed with the Texas Public Utility Commission (PUC), are exempt from license fees.
